About Local Law 55: The Asthma-Free Housing Act

NYC’s Local Law 55, or the “Asthma-Free Housing Act”, was passed in 2018 to fight the rising asthma rates and improve the quality of life for millions of New Yorkers. The law requires multiple-dwelling property owners (buildings with 3 or more apartments or if a tenant has asthma) to remove and take preventative measures against indoor health hazards that may trigger asthma, including:

The New York City Department of Housing Preservation and Development (HPD) and Department of Buildings (DOB) are actively enforcing Local Law 55, and failure to comply could result in complaints from tenants, costly violations, and potential litigation.

Important Criteria & Landlord Responsibilities

Violations are issued by NYC HPD to any landlord not compliant with Local Law 55 regulations and can be as large as $10,000 per occurrence.

We advise all landlords to familiarize themselves with this law and its compliance requirements. If you are a landlord or property manager in NYC, here are the basic requirements of Local Law 55:

  1. Perform annual inspections of all dwellings and common areas for indoor allergen hazards such as mold, rodents, and cockroaches.
  2. Respond to mold and pest complaints from tenants and violations from the HPD.
  3. Provide an annual notice and fact sheet to current and prospective tenants at the time of lease signing or renewal, and ensure that vacant apartments are cleaned and free of pests and mold before a new tenant moves in.
  4. Correct underlying conditions that cause mold and attract pests.
  5. Utilize integrated pest management to address existing pest infestations and ensure that your property is properly sealed from pests. 
  6. Implement safe work practices when remediating mold and fixing underlying causes.

Mold

Our inspectors provide a report that includes the type of mold, moisture levels, and relative humidity. We also identify the underlying cause(s) and provide plans and recommendations for remediation.

Under Local Law 55 and Local Law 61, if more than 10 square feet of mold is found in a residential property with 10 or more units, the landlord is required to hire two independent contractors to address the issue. The first is a New York State Department of Labor-licensed mold assessor, and the second is a New York State Department of Labor-licensed mold remediator.  These two contractors must be separate and independent from one another.
